Information You Provide Directly.

Information Collected Automatically.

Information from Third Parties.

  • Legal obligation: Where processing is necessary to comply with a legal obligation, including the Estate Agency Affairs Act, the Financial Intelligence Centre Act (FICA), and other applicable legislation.
  • Legitimate interest: Where processing is in our legitimate business interest and does not override your fundamental right to privacy.

Where we rely on consent, you may withdraw that consent at any time without affecting the lawfulness of processing prior to withdrawal.

How We Use Your Personal Information

We use the personal information we collect for the following purposes:

  • To respond to property enquiries and provide you with information relevant to your property needs
  • To facilitate the sale, purchase, or rental of property, including the preparation and processing of mandates, Offers to Purchase, and lease agreements
  • To verify your identity and conduct FICA-required due diligence checks

  • To refer you to bond origination, legal conveyancing, or other professional service partners (only with your consent)
  • To send you property listings, market updates, and promotional communications (only where you have opted in or where permitted under POPIA and the CPA)

  • To manage our internal CRM and operational systems
  • To comply with our legal and regulatory obligations

Direct Marketing

In accordance with Section 69 of POPIA and the Consumer Protection Act (including the 2026 Amendment Regulations), we will only send you unsolicited electronic direct marketing communications where:

  • You have opted in to receive such communications from us; or
  • You are an existing client and the communication relates to similar products or services, and you have been given a clear and easy opportunity to opt out.

You have the right to opt out of direct marketing at any time. Every marketing communication we send will include a clear and accessible opt-out or unsubscribe mechanism. If you have registered on the National Consumer Commission (NCC) opt-out registry, we will remove you from our active marketing database during our monthly database cleansing process, as required by the amended CPA Regulations effective April 2026.

Disclosure of Your Personal Information

We do not sell your personal information to third parties. We may share your personal information with the following parties only where necessary and appropriate:

  • Leapfrog franchise offices and registered agents: To facilitate property transactions and enquiries relevant to your requirements.
  • Bond originators and home loan partners (e.g., BetterBond/BetterLife): Where you have indicated a need for home loan assistance and have consented to the referral.
  • Conveyancing attorneys: Where a property transaction has been concluded and transfer or bond registration is required.
  • Third-party service providers: Including our CRM platform providers, website hosting companies, email marketing platforms, and analytics providers, who are contractually bound to process your information only as instructed by us and in compliance with POPIA.
  • Regulatory and law enforcement authorities: Where required to do so by law, court order, or in the legitimate exercise of our legal obligations (including FICA compliance).

Where we share your information with third parties, we take appropriate steps to ensure that those parties are subject to comparable data protection obligations.

  • Enquiry and lead data: Retained for up to 24 months from the date of last engagement, unless a transaction results or you request earlier deletion.
  • Transaction records (sale, purchase, or rental): Retained for a minimum of 5 years in accordance with statutory and professional obligations.
  • FICA documentation: Retained for a minimum of 5 years following the conclusion of the transaction, as required by the Financial Intelligence Centre Act.
  • Marketing consent records: Retained for the duration of the marketing relationship and for a reasonable period thereafter to demonstrate compliance.

Once your personal information is no longer required, we will take appropriate steps to securely delete, destroy, or de-identify it.

Security of Your Personal Information

We take the protection of your personal information seriously and implement appropriate technical and organisational measures to safeguard it against loss, unauthorised access, misuse, alteration, or destruction. These measures include:

  • Secure, password-protected CRM and internal systems with role-based access controls
  • SSL/TLS encryption on our website

Transborder Transfers of Personal Information

We may transfer your personal information to third parties located outside of South Africa where necessary, for example when using cloud-based CRM or marketing platforms hosted in other jurisdictions. We will only transfer your personal information outside of South Africa where:

  • The recipient country provides an adequate level of protection consistent with POPIA; or
  • The recipient is subject to a binding agreement or data processing agreement that ensures equivalent protection; or
  • You have consented to the transfer.

By engaging our services and accepting this policy, you acknowledge that your personal information may be processed outside South Africa in the circumstances described above.
